1. Agreement to these terms
These Terms of Service ("Terms") are an agreement between you and Ainsley Elizabeth Gift Co. ("Ainsley Elizabeth," "we," "us," or "our"). By accessing or using this website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.
If you use the website on behalf of a company or other organization, you represent that you have authority to act for it. You must be at least 18 years old and legally capable of entering into a contract to place an order.
2. Inquiries, proposals, and orders
This website is an inquiry-led service. Submitting a form, discussing a project, or receiving an automated acknowledgement does not create an order, reserve inventory, or require either party to proceed.
An order is formed only through the acceptance process described in the applicable written proposal, order confirmation, or service agreement (the "Order Terms"). The Order Terms will set out the approved gifts or services, quantities, price, taxes, delivery arrangements, payment schedule, cancellation or refund policy, and other project-specific requirements. You will have an opportunity to review those terms before committing.
If these Terms conflict with Order Terms, the Order Terms control for that order. Nothing in either document limits a right or remedy that cannot lawfully be excluded.
Pricing and payment
Published Classic, Signature, and Grand package prices are in Canadian dollars and exclude applicable taxes and any stated delivery or customization charge. Custom work and other project-specific pricing will be confirmed before an order is accepted.
Cancellations, returns, and refunds
The cancellation, return, exchange, and refund terms for an order will be disclosed in its Order Terms before you commit. Custom, personalized, perishable, and time-sensitive gifts may require different terms from standard gifts. Any rights you have under applicable consumer-protection law continue to apply.
3. Gifts, availability, and delivery
Availability and substitutions
Core package contents are listed on the Signature Gifts page. Candle scents and chocolate selections vary with availability. We do not offer general product substitutions; Grand's wine may be replaced with a non-alcoholic beverage on request. Colour and appearance may vary slightly from photographs and screen displays.
Dietary needs and allergens
Food products may contain or come into contact with common allergens. We do not currently promise allergen-free, dietary, or seafood-free alternatives. Tell us about recipient requirements before ordering so we can confirm whether a gift is suitable. Recipients should review product labels and ingredient information before consumption.
Alcohol
Grand includes wine unless a non-alcoholic beverage is requested. We purchase wine only after receiving a paid customer order and do not keep alcohol inventory. The purchaser and recipient must meet the legal drinking-age and delivery requirements that apply. Identification and an adult signature may be required. We may refuse or modify an alcohol-related request when necessary to comply with law or delivery-partner rules.
Local delivery
We offer local delivery across the Vancouver area, including North and West Vancouver, Maple Ridge, Langley, and Tsawwassen. Delivery is $20 for orders below $249 plus tax and free for orders of $249 or more plus tax. Delivery method, address, and timing are confirmed in the Order Terms. Delivery dates or windows are estimates unless expressly guaranteed in writing.
You are responsible for providing complete and accurate delivery details through the method we specify and for ensuring the recipient can accept the gift. We will address failed, delayed, refused, or incorrect-address deliveries under the applicable Order Terms and mandatory law.
4. Acceptable website use
You may use this website only for lawful purposes. You must not:
- interfere with the website, attempt unauthorized access, or bypass security measures;
- introduce malicious code, scrape the website at an unreasonable rate, or misuse forms;
- impersonate another person or submit false, misleading, unlawful, or infringing content; or
- use website content in a way that violates intellectual-property or other rights.
We may restrict access or take other reasonable steps to protect the website, our business, or others.
Intellectual property
The website and its text, design, graphics, photographs, logos, and other content are owned by or licensed to Ainsley Elizabeth and are protected by intellectual-property laws. We grant you a limited, revocable, non-transferable right to access the website for your own lawful, non-commercial evaluation of our services. No other rights are granted.
Your submissions
You retain ownership of materials you provide. You give us permission to use them only as reasonably necessary to respond to your inquiry, prepare or fulfil an approved order, and operate our services. You represent that you have the right to provide those materials and instructions.
Third-party services and links
The website may refer or link to third-party websites, makers, products, or services. We do not control third-party websites and are not responsible for their content, availability, or privacy practices. A reference does not necessarily mean we endorse every third-party claim or offering.
5. Disclaimers and limitation of liability
The website is provided on an “as is” and “as available” basis. We aim to keep its content accurate, but we do not guarantee that the website will always be available, secure, error-free, or current. Website content is general information and is not professional advice or a binding offer.
To the maximum extent permitted by law, Ainsley Elizabeth and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, data, goodwill, or opportunity, arising from your use of or inability to use the website.
These exclusions do not apply to liability that cannot be excluded or limited under applicable law, including any mandatory consumer rights. Liability relating to an accepted order is governed by its Order Terms and applicable law.
6. Governing law
These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there, without regard to conflict-of-law rules. Subject to any mandatory rights or forum available under applicable law, disputes relating to these Terms or the website may be brought before the courts of British Columbia.
7. Changes and general terms
We may update these Terms as the website or our services change. Revised Terms take effect when posted with a new effective date and apply prospectively to website use. Changes to an accepted order require agreement under its Order Terms.
If any provision is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement about use of this website; accepted orders remain subject to their Order Terms.
8. Contact us
Questions about these Terms can be sent through our Plan a Gift form. Choose “Other” and write “Terms question” at the beginning of your message.
